This website does not add anything new to the flaws in the legal system. This website is merely about the reality of the injustices already at play.The problems mentioned here have existed much too long and serve no useful purpose whatsoever except to promote the lazy or incompetent professionals in the helping professions. It is time to stop buying human beings by the penny and selling them by the pound to the courts or using them simply for selfish personal profit, ego and greed. If you are about to go to jail or just got out of jail and you are reading this then we can probably deduce the following about you. You can read, you are computer literate, you are of average intelligence and maybe curious about what this website is all about. We might also deduce that you are simply computer literate because you have honed your skills in the field of Identity theft, wire fraud, etc, and that your intelligence left you long ago and in no way are you going to stop committing crimes. In the case of the latter, get off the computer, and turn yourself into jail. That's where stupid people usually end up. Why prolong the event? Get it?
Sometimes basic rights to competent legal representation and fair medical and mental health treatment while in jail is neglected. Those who lack the knowledge and courage to fight back for fear of deeper neglect or retribution will now have a voice.
When you are read your Miranda Rights you are told you have the right to remain silent! Second you are told that anything you say can and will be used against you in a court of law. You will be told that if you cannot afford an attorney one will be appointed for you. Keep your mouth shut stupid! Lie to the Cops......go to jail! They lie to you............ok! Don't like it? Too bad that is just the way it is.
Jail is where it all begins. Approximately 24-72 hours after you are booked into jail, not counting weekends, someone shows up at the jail to interview you about your finances and makes a determination whether or not you can afford an attorney. If not an attorney will be appointed by the court to represent you. Unless you hire your own attorney you won't have a choice into the matter of which attorney the court appoints for you.You do have the right to interview your attorney. After all you are paying them not the state.You have the right to know what credentials and experience, and abilities of your attorney possesses.
How long will it be before the attorney finds out you are his client? How long will it be before he/she gets around to contacting you face-to-face? Who knows! Sometimes it is five minutes before the court hearing and sometimes it will be at the jail for five minutes or less through the glass. Sometimes you won't see your attorney for a week or more while you languish away in jail. If you try to call him/her the secretary usually answers the phone. Often when she identifies you as a client he/she sometimes just hangs up or gives some excuse that the attorney is in court or busy and offers to tell him you called. What is wrong with this picture? Nothing like a letter to the bar association gets an attorney's immediate attention. Just have your ducks in line when you complain about being screwed. The Oregon State Bar Association investigates every complaint and will send the attorney a letter telling him/her you filed a complaint. At some point the complaint may even become public.You will receive a letter back from the Oregon State Bar Association stating that they received you complaint and what if any action they are going to take. If you have a legitimate complaint leave the emotion out of it and state just the facts. Do the right thing for once and just tell the truth. Best of all, if you don't like being in jail then stop committing crimes.
If you are prescribed essential medications for any mental condition be prepared for the medical department to discontinue the medicines abruptly. Some licensed medical professionals will not prescribe inmates any medicines for their mental state if the medicines have a sleep component in them. More often than not the medicines that treat mental illness cause drowsiness. Medicines specifically used to help inmate sleep in some jails is a no no regardless how tormenting a mental illness is. A lot of the time the Licensed Medical Professionals will give you the medicines they like even if the medicines are different. In most cases cheap medicines are an incentive to distressed jail budgets. Even though the medicines are cheaper studies show they are often just as effective as the newer drugs used to treat mental illness. The problem is the side effects coming off one medicine abruptly and getting used any side effects the new medicines may produce. Waiting four to six weeks for an older cheaper medicine to work and suffering both the side effects of of the discontinuing of one and the time it takes to get used to the other can be hell. Not to mention the torment of the condition worsening before it gets better from starting the treatment all over again for the illness you have. What about the anxiety, frustration and torment caused the by the health professional to the inmate inmate from improperly treated mental illness?
If you go to jail make sure your legally prescribed medicines are up to date. Ask the arresting officer to allow you to take them with you to jail. Make sure you have taken them as prescribed, that there is the right amount left according to prescribing date and the pharmacy records of your picking them up on time coincides with you saying that you have been compliant with dosing instructions. When you arrive at the jail ask the intake staff when you can expect the next dose of your own medicines. Let them know you have your medicines with you and want to continue them. Inform the medical staff of all sources of current treatment and the names of treatment providers and pharmacies. Make sure the right pills are in the right containers. Any "M&M" appearances in any of the pill containers will get them stopped immediately! Make sure your medicines are in their own respective and clearly labeled original containers and that they really do belong to you. Jail is not the place to suddenly become religious about taking the medicines you forgot to take on the outside. Jail is also not the place to get controlled substances to continue the habits you came in with. Jail is supposed to elevate anxiety. Some jail policies allow medical staff up to two weeks before they actually have to see you and refer you to mental health. Of course medical emergencies and obvious mental health problems are seen immediately. Even a few days is a long time to go without essential mental health medications. If you come to jail stoned out of your gourd, drunker than a Lord, expect to have a drying out period. Even the most competent and caring professional can't talk to a drunk or a tweeker. That kind of behavior more often than not tells the truth of how you take care of yourself on the outside. If you don't care about your mental health why should society be burdened with the responsibility?
What can you do if you are denied your own medicines or made to wait until the medical professionals "get around to it" to get your medicines started? First request to the medical staff verbally that you be allowed to continue to take the medicines that your own doctor has prescribed for you. If denied ask again in writing by way of a kite. If that fails ask your attorney to get involved. Ask your relatives to get involved. Ask them to call or write the Sheriff and ask for his assistance. Write to the judges, the Commissioners, to your congressmen and women and N.A.M.I. Keep copies of all correspondence you send and all you receive back. Tell the newspaper about any ill treatment you are getting. Write to all of them! If you are worried that the system will read and refuse to send your mail then send it to your attorney to be sent by him to the editor. Sending or receiving "legal mail" to your attorney is not supposed to be read by anyone except your attorney and the person you designate to read it. Make a duplicate copy of all official mail you send out. You don't have access to a copy machine. So make a duplicate the hard way. Write it out again! Try spending as much time doing what is right as what you did that got you locked up again for the umpteenth time. All complaint get investigated and more often than not it stays on file indefinitely.
